Conservation Commission Minutes 4/18/07
FINAL

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chairman, Pam Goff, Bruce Bartels, Ray Kellman, Virginia Dyer, David Flanders, Rusty Walton, and Chuck Hodgkinson.  Also attending were Debbie Hancock, Reid Silva, Al Hedin, Bertrand Taylor and Tim Carroll.  Russell Maloney was absent.    

Mr. Steves opened the meeting at 1:30 to announce one site visit:  45 Beach Rd. (Taylor).

PUBLIC MEETING RFD AL HEDIN FOR BERTRAND TAYLOR; AP 2-3:  Mr. Steves opened the public meeting at 2:15 PM and summarized the observations made on the earlier site visit.  Mr. Taylor summarized the Seven Gates regulations that do not allow views to neighboring properties or from the beach to any houses.  Mr. Hedin summarized the selective pruning and methods that will be used to restore the water views while meeting all regulations.  With no further comment from the audience a motion for a negative determination was made, seconded and unanimously approved.  

CONTINUED PUBLIC MEETING RFD MARCIA CINI FOR LORUSSO/LOCHRIDGE, AP 25-130:  Mr. Steves read a letter from the applicant requesting a continuance to May 16 @ 2:15 PM.  A motion to accept the request was made, seconded and unanimously approved.

CONTINUED PUBLIC HEARING REID SILVA FOR DEBBIE HANCOCK AND JEROME KENNEY; NOI SE 12 - 533; AP 27.1-119, 120:  Mr. Steves opened the continued hearing at 2:19 PM for a bulkhead revetment to stabilize the eroding bank and read the comments from the DEP letter assigning a file number.  Ms. Hancock confirmed that the structure pre-dates 8/10/78.  Mr. Steves continued by confirming state statute 10.30 # 6, 7 and 8 shall apply to this case.  He commented that the Commission does not want any further erosion in the harbor basin and is interested in the angle of wave deflection.  There was discussion among the Commissioners regarding the advantages and disadvantages of soft structural support methods and their ability to deflect wave action.  Mr. Silva added he did not think soft core logs would be secure in this harsh environment of ice freezing and harbor traffic in the summer.  He did not think it is stable enough to allow time for the seed to germinate, take hold and stabilize the bank with a natural buffer.

Mr. Silva outlined how a four-foot high fiberglass bulkhead will catch the natural grade and is needed because the bank is too steep to naturally stem the erosion.  The pilings would be installed from a barge and the sheeting will be installed by hand.  Ms. Dyer summarized a conversation she had with the region’s DEP representative who recommended a vegetated solution.

Mr. Silva reiterated that he did not think a natural solution would be successful and added he would gladly plant crawling vines of some sort to help mask the revetment.  Ms. Goff added the Commission is not as concerned with aesthetics as with doing the right thing to stop bank erosion and admitted a softer solution may not work in this case.  The Commission agreed something must be done quickly.

After brief discussion Ms. Dyer made a motion recommending the applicant hire a more experienced professional before approving the plan.  The motion was seconded for discussion that stated this suggestion may take too long as the bank is eroding and unstable.  The motion was defeated with a vote of one in favor and five opposed.

A subsequent motion to accept the plan as presented with two conditions:  1.  The engineer must have the specific design and methods for finishing the two ends of the bulkhead approved by the Conservation Officer before work commences.  2.  The Conservation Officer shall approve the final re-planting plan before the work commences.  The motion was seconded and approved with a vote of five in favor and one opposed.
CONTINUED PUBLIC HEARING GLENN PROVOST FOR PACER NOMINEE TRUST – BARBARA FOSTER TRUSTEE:  NOI SE 12 – 532; AP 35-1.15:  Mr. Steves opened the continued hearing at 3:00 PM and read a letter from the applicant requesting a continuance to May 16 @ 2:00 PM.  A motion to accept the request was made, seconded and unanimously approved.

RUSTY WALTON UPDATES:  Mr. Walton updated the Commission on the emergency certification request to stabilize the rock revetment on the east end of the Squibnocket Beach parking lot.  The contractor and engineer will scrape the debris caused by the storm into the holes in the revetment.  A motion to approve the emergency notice for repairs was made, seconded and unanimously approved.

Messrs. Steves and Flanders agreed to attend the Certificate of Compliance inspection with the DEP representative on April 30 @ 11:00 am – 25 East Lane; SE 12 – 353; AP 32-68.1.

ADMINISTRATION:

The Taylor Determination of Applicability (AP 2-3) was signed.
The 9 Azalea Trust Order of Conditions was signed and notarized (SE 12 – 521; AP 29-8).

MINUTES:  The review of the 4/4/07 meeting minutes was postponed to the next meeting.

With no further business to conduct the meeting adjourned at 3:30 PM PM.
